and south of your property, as well as from directly east. Observations should also be made from <br /> locations low (near the water line) and high (near the dune) on the beach. If you are able to see <br /> the source of light(e.g., light bulb) within a fixture, that light is likely to cause problems for sea <br /> turtles. <br /> Under a 1992 fine schedule approved by county resolution, failure to correct the above referenced <br /> violation (s)can result in citations assessed at $50.00 for each day of the violation after a warning <br /> notice has been issued with 24 hours to comply. Indian River County can also bring sea turtle <br /> lighting violations before the code enforcement board,which can enter an order and fines(usually <br /> $100 per day) if compliance is not achieved by a board-established compliance date. Be advised <br /> that property owners are ultimately responsible for the actions of anyone on their proyerty <br /> that violates lighting restrictions including guests and renters and property owners will be <br /> subject to penalties accordingly. <br /> Indian River County has the privilege of being one of the most important sea turtle nesting areas <br /> in the Western Hemisphere. In addition, the county has a federally mandated Habitat <br /> Conservation Plan (HCP) for Sea Turtles in accordance with its permit to help protect beachfront <br /> homes from storm erosion. The.reduction of lighting impacts on nesting turtles is a part of the <br /> County's HCP.
