BOOK � F'.G1330 <br />In trying to evaluate whether this 2500' separation distance <br />is excessive, staff contacted other jurisdictions to deter- <br />mine what regulations they used and whether these regu- <br />lations were effective. In doing this, staff outlined the <br />objectives which this type of ordinance is meant to achieve. <br />Staff also tried to find uniform distance standards which <br />correlate a specific separation distance to the objectives <br />identified by staff. <br />This work aided the staff in reaching the conclusion that a <br />separation distance between churches and schools, and the <br />alcohol sales establishments, sould be enforced. However <br />this separation distance should be modified. Staff has also <br />recommended that the ordinance be changed so that alcohol <br />sales establishments where on -premises consumption of <br />alcohol is permitted be differentiated from alcohol sales <br />establishments where the on -premises consumption of alcohol <br />is prohibited. <br />Staff has recommended that Indian River County's required <br />separation distance be changed to -require a 500' separation <br />distance between churches and schools, and alcohol sales <br />establishments (excluding beer sales) where on -premises <br />consumption of alcohol is prohibited. Staff further <br />recommends that a separation distance of 1000' be estab- <br />lished between churches and schools and alcohol sales <br />establishments where the on -premises consumption of alcohol <br />is permitted. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners <br />adopt the proposed revisions to Chapter 2, "Alcoholic <br />Beverages" of the County Code. <br />The Chairman asked if anyone present wished to be heard. <br />There were none. <br />ON MOTION by Commissioner Scurlock, SECONDED <br />by Commissioner Bowman, the Board unanimously <br />closed the public hearing. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED <br />by Commissioner Bowman, to adopt Ordinance 85-2 <br />amending the County Code re zones for sale of <br />alcoholic beverages. <br />Commissioner Wodtke noted that we would be going to 500' <br />rather than 2500', and Director Keating stated that this would be <br />true only where on -premises consumption is not permitted; other- <br />wise it would be 1,0001. <br />40 <br />_I <br />
