F - <br />JAN 2 1.985 <br />nox 59 <br />lots that have been sold, but require the remainder of the subdi- <br />vision to be built according to the present Code. <br />Attorney Brandenburg recommended, if the Board wished to <br />proceed in that direction, that they require Mr. Powell to do a <br />boundary plat of all the lots and put it on record and then grant <br />a variance to other requirements of the Subdivision Ordinance. <br />Mr. Powell then will have a plat on record showing these lots as <br />legally constituted and he will have met the requirements of the <br />current Subdivision Ordinance so that when someone buys one of <br />these lots, they will be able to get a building permit. He noted <br />that it will be an additional expense to plat the lots. <br />Mr. Howard did not believe Mr. Powell would be upset with <br />subdividing and platting the property, but the tremendous <br />hardship would be paving the roads and paving a right-of-way all <br />the way out to Old Dixie as had been suggested. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED <br />by Commissioner Wodtke, to adopt the County Attorney's <br />recommendation and provide a vehicle for this property, <br />which has been caught between the new and the old, to <br />conform and allow the owner good use of his property, <br />i.e. require the applicant to plat the boundaries of <br />the lots and where necessary give him variances for <br />certain requirements of the subdivision ordinance, <br />such as paving, etc. <br />Mr. Howard asked if it is necessary to go through the <br />Planning Department for all this or just go to the Commission, <br />and Attorney Brandenburg explained that in order to grant a <br />variance, there will have to be a public hearing, but he felt <br />the Board has indicated their position. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously. <br />70 <br />
