JA N 9 1995 aooK 59 ucF 42 <br />46th Avenue between 8th Street and 9th Place <br />Director Davis explained that the County had received a petition <br />signed by 9 of the 12 property owners on the street, representing <br />66.70 of the property owners. <br />Commissioner Wodtke asked what percentage of the front footage <br />was needed for approval of the petition paving, and Attorney <br />Brandenburg advised that neither a majority of the property owners nor <br />the owners of front footage was needed and that the Board could <br />proceed on its own. <br />Commissioner Scurlock wished to see a simple majority, 50% plus <br />one, for the petition paving, and asked if there was some <br />administrative problem with having to look so closely at the 66.7% and <br />finding out later that someone has removed their name from the <br />petition. <br />Director Davis said that once they have the consent of 66.70 of <br />the property owners, they consider it a valid petition and move <br />forward to put it on the list and bring it to the Board. <br />Chairman Lyons opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. <br />John Vicek, 940 46th Avenue, stated that they have been trying <br />for a long time to get their street paved as it serves as a throughway <br />into Glendale Lakes Subdivision. He reported that there are only <br />three property owners who did not sign the petition, and the reason <br />they did not sign is because they live on corners. <br />J.B. Egan, III, explained that he was one of the three residents <br />who had not signed the paving petition, and did not because he did not <br />particularly want or need the street paved; however, he does <br />sympathize with his neighbors and could understand why they wanted the <br />street paved. <br />Eugene Folkman, 910 4th Avenue, spoke in favor of the paving and <br />pointed out that after a downpour the swells overflow into the street. <br />David Cairns, Attorney representing property owner Elizabeth <br />Earman, felt there were some inequities in regard to the assessment <br />procedure, as the paving would not be beneficial to his client's <br />26 <br />_ M M <br />
