� _ r <br />Commissioner Lyons felt that he would vote for the assessment as <br />proposed because he believed that we can't guess whether or not the <br />8 -acre parcel behind the Earman lot could be subdivided at some time <br />in the future and that the paving of 46th Avenue would make that <br />parcel more valuable. <br />Toni Adams, 941 46th Avenue, understood that the Board is <br />considering taking part of the property out and reassessing the <br />remainder, and strongly objected to that being done. She stated that <br />if she did not live on the street, she wouldn't care if it was paved <br />either. <br />Commissioner Wodtke explained his position on taking the Earman <br />property out of the assessment was because, basically, the ordinance <br />says that the assessment must benefit a property owner. In addition, <br />he felt there is some inequity in this situation because of the <br />drainage. <br />Mrs. Adams stated she is against picking up the extra cost if the <br />Earman property is excluded from the assessment. She pointed out that <br />she has two lots, one of which is undeveloped. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wodtke, the Board unanimously closed <br />the Public Hearing. <br />Commissioner Scurlock felt there was no way to always have an <br />equitable situation in these assessments, and he recommended that the <br />petition paving assessment procedure not be changed. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, that the Board adopt Resolution <br />x/85-09, providing for certain paving and drainage <br />improvements to 46th Avenue between 8th Street and <br />9th Place; approved the preliminary assessment roll in <br />the amount of $24,588 to be allocated from the petition <br />paving fund; and authorized the Road & Bridge Dept. to <br />schedule construction. <br />29 <br />JAN 1995 R�:oa 5 F,1 F 4?4 <br />
