JAN 2 3 1995 BOOK 59 FIAU 6 <br />property owners in favor of the County accepting it as a public <br />city road so that the City will maintain it and fix the drainage. <br />(SAID PETITION IS ON FILE IN THE OFFICE OF THE CLERF) <br />In addition, another owner has agreed to go along with the <br />majority, which makes it 18 out of 23. He reported that the <br />contractor is repairing the road just to the north of this, so if <br />this matter is settled today, the City might be able to get <br />Terilil Terrace Road repaired at the same time. <br />Attorney Brandenburg recalled that the last time this came <br />before the Board the City wanted it, but there were a lot of <br />residents present that did not want it and urged the Board not to <br />take action. However, the City has gone out and obtained the <br />signatures of the majority of residents that are in favor of the <br />road going through so that the City will maintain the road. <br />MOTION WAS MADE by Commissioner Wodtke, SECONDED by <br />Commissioner Bowman, that the Board adopt Resolution <br />85-14, accepting as a public road a portion of 33rd <br />Avenue and 15th Street, located in Terilil Terrace <br />Subdivision in the City of Vero Beach. <br />Under discussion, Chairman Lyons asked if anyone wished to <br />be heard in this matter. <br />Benjamin C. Natale, 1530 33rd Avenue, explained that he had <br />been unaware of the petition until just recently and was <br />concerned as to how his home would be affected by the road being <br />cut through as he has sprinkler heads right on the cul-de-sac. <br />He wanted to know who would bear the expense of moving them. <br />Attorney Vitunac felt that it might also affect Mr. Natale's <br />driveway, mailbox, etc. and explained that the City has not <br />determined yet whether the City will pay for any expenses <br />involved or whether an assessment will be made. He advised that <br />the City would abandon the cul-de-sac edges back to the <br />individual property owners and Mr. Natale would actually acquire <br />property. <br />47 <br />
