In a <br />subdivision where there is a lot on each side of a road, there is <br />a presumption, unless there is a reverter clause, that the <br />easement would be split evenly between those lots. In this <br />particular case, the abandonment just happens to benefit one <br />particular person. <br />Chairman Lyons opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. There were none. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously closed <br />the Public Hearing. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wodtke, the Board unanimously adopted <br />Resolution 85-16 providing for closing, abandonment, <br />and vacation of that portion of 6th Street lying west <br />of the west right-of-way line of 26th Avenue, located <br />in Hallmark Homes Subdivision, and reserving unto the <br />County easements for drainage and utility purpose. <br />39 <br />
