FEB 2 O 1985BOOK 59 Ut 11914 <br />Also, the owner is proposing to upgrade and construct improve- <br />ments over and above what is required in the existing contract. <br />These improvements include: <br />1) upgrading from a 6" limerock base to an 8" limerock <br />base, <br />2) upgrading the asphalt surface course from a thickness <br />of 14" to 1;2-", <br />3) installing Miami curbing along the roadway. <br />Revised construction drawings showing these additional improve- <br />ments have been submitted, and have been approved by the Public <br />Works Director. A new certified cost estimate has been submit- <br />ted which reflects the additional cost of the proposed new <br />improvements, balanced by expenditures for some of the con- <br />struction that has already occurred on the site. Staff has <br />determined that the amount of $503,191.24 represents at least <br />115% of the costs of construction -needed to finish the project <br />under an amended contract. <br />The County Attorney's Office has drafted a proposed resolution <br />and assumption agreement (see attachment #3) that acknowledges <br />the assignment of Seagrove West subdivision to Harbor Federal, <br />grants a 9 month extension of the existing contract to <br />construct the required improvements, and accepts the newly <br />posted security guaranteeing the contract. Attached to the <br />resolution is an assumption agreement whereby Harbor Federal <br />agrees to perform the promises and obligations of the old <br />contract as well as the additional modifications to upgrade the <br />original construction plans. Harbor Federal is posting a <br />letter of credit for $503,191.24 as surety for the contract <br />extension, and is in agreement with the proposed resolution and <br />assumption agreement. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt <br />the proposed resolution assigning and extending the existing <br />contract for the construction of improvements in Seagrove West <br />subdivision to Harbor Federal Savings & Loan Association. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously adopted <br />Resolution 85-22 assigning and extending the <br />existing contract for the construction of improve- <br />ments in Seagrove West Subdivision to Harbor Federal <br />Savings & Loan Association. <br />
