r � � <br />Attorney Brandenburg commented there is one other thing. If <br />the County doesn't replace this capacity because the City does <br />not ask for it and we have our impact fees in escrow, how long do <br />we hold them and when do we return them to the customers? <br />It was felt that is up to the County. <br />Attorney Brandenburg stated that there ought to be an <br />outside number of years on the County's obligation to accept the <br />City's request for this capacity; it can't go on forever. He <br />felt it should be something like ten years. <br />City Manager Little agreed that insofar as capacity <br />transfers are concerned, if that right hasn't been exercised <br />within ten years from the date of the agreement, it terminates. <br />Attorney Brandenburg felt that would be fine, and then we <br />could return the escrow money to the people. <br />This was agreed on. <br />Commissioner Scurlock and Commissioner Bird added the <br />following to their Motion: <br />The City's right to request the return of said capacity <br />to terminate in ten years; the appropriate language to <br />be furnished by the Attorney in regard to the impact fees. <br />THE CHAIRMAN CALLED -FOR THE QUESTION as amended. <br />It was voted on and carried unanimously. <br />MK <br />FEB 2 0 1985 BooK 59 9S <br />
