Pint4eWces Director, Utilit <br />ECT: <br />CABLE TELEVISION <br />ORDINANCE 82-7 <br />FROMgoyce S. Hamilt A�ar <br />REFERENCES: 1)Proposed <br />Franchise AdminisOrdinance <br />Utility Services <br />DESCRIPTION AND CONDITIONS: <br />- The Board, during a public hearing concerning cable television <br />rates held February 18, 1985, directed staff to revise the <br />definition of "Gross Revenues" as it is defined in Ordinance 82-7. <br />ANALYSES: <br />Ordinance 82-7 did not include language which would have allowed <br />the Board to collect franchise fees from gross revenues received <br />from the sale of premium/pay channel subscription services and <br />from the sale, rental, and/or installation of subscriber premises <br />equipment. <br />It has come to the attention of the Board that the County is <br />entitled,to receive franchise fees on these services. <br />Therefore, Ordinance 82-7'has been revised to amend the definition <br />of "Gross Revenues" to allow this additional source of revenue to <br />be included in the calculation of the franchise fee (Exhibit "1"). <br />RECOMMENDATION: <br />The staff recommends the Board approve and authorize its Chairman <br />to execute the amended ordinance. <br />Franchise Administrator Joyce Hamilton presented <br />staff's recommendation for approval of the amended <br />ordinance. <br />Chairman Lyons opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. <br />Billy Crosby, Manager of Florida Cablevision, <br />questioned the definitions of "not limited to" and "sale of <br />equipment." He noted that Florida Cablevision does not sell <br />equipment other than minor odds and ends, and it would be <br />very troublesome for him to have to track these minor sales; <br />41 <br />MAR 13 1985 Boor CIO FAcF 64 <br />
