Further discussion ensued regarding access and soil condi- <br />tions, and Commissioner Wodtke did not believe that we got a <br />direct answer from Mr. Powell as to what he would be willing to <br />do, i.e., file the necessary document to indicate the roadways, <br />address the drainage and utility easements, etc. <br />Mr. Powell noted that they were just told Monday about the <br />drainage and they have not had time to see how much all this <br />would cost. He pointed out that there are power lines in there <br />now, and Commissioner Scurlock stated that Mr. Power could give <br />the easements on the lots he still owns, but on those that are <br />sold, their owners would have to give the easements. He con- <br />tinued that he does not see this as a situation of asking Mr. <br />Powell what he is going to do, but felt the Board should tell him <br />what he is going to do fof the health, safety and welfare of the <br />community. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED <br />by Commissioner Wodtke, to grant Mr. Powell a variance <br />to the required improvement section of the Subdivision <br />Ordinance so that paving of the roadways will not be <br />required, the roads just to be consistent with others <br />in the area; the roadways will have to be indicated on the <br />plat, and Mr. Powell will have to go through the platting <br />process, showing all easements, etc. <br />Commissioner Bird noted that the net effect is that Mr. <br />Powell will have to go through the subdivision process minus the <br />paving requirement. <br />Commissioner Bowman asked why he would not be required to <br />pave, and Commissioner Scurlock believed it is a matter of <br />reasonableness. Even though he believed Mr. Powell was looking <br />for the loophole, he was led to believe it was there; he was <br />acting in good faith; and he did get caught in the middle. <br />39 <br />600 F'P P°,�E 215 <br />
