stated that he, personally, did not submit the original site plan <br />and confirmed that there has been no change in ownership since <br />that time. <br />Attorney Brandenburg swore in Robert Jackson, attorney, <br />representing the Village Green West Homeowners' Association, who <br />stated he was somewhat shocked that no reason has been given here <br />about why these deletions are being proposed. He stressed that <br />this all came about after the residents complained to the <br />Planning Department, and Director Keating agreed with the <br />residents at that time that certain improvements needed to be <br />made, such as the gazebo, boat docks, etc. Attorney Jackson <br />quoted the following paragraph from a letter written by Director <br />Keating to Florida Atlantic after these omissions were brought to <br />his attention: "The County's Zoning Code requires that all <br />depicted site plan improvements be installed and maintained. <br />Failure to do so constitutes a code violation that may be subject <br />to Code Enforcement Board action. To resolve these violations, <br />the staff requests that you submit a construction schedule within <br />two weeks indicating a reasonable timetable for completion of the <br />above listed discrepancies, as well as conformance with any other <br />conditions of the approved site plan." Attorney Jackson <br />emphasized that this letter was sent prior to Florida Atlantic <br />requesting a modification of their site plan. The developer was <br />told that a modification of site plan would have to go before the <br />Planning & Zoning Commission, which denied their request. <br />Attorney Jackson stressed that when people were interested <br />in buying at Village Green West, they were taken to other phases <br />of Village Green and given color brochures showing the proposed <br />site plan with drawings of the gazebo, boat docks, etc. <br />BROCHURES ARE ON FILE IN THE OFFICE OF THE CLERK <br />Attorney Jackson continued that the residents of Village <br />Green West are paying premium dollars for their mobile homes <br />because of the amenities promised and pointed out that the front <br />MAR2 7 1995 30 bubF. 60 F��E <br />
