r <br />AR 198 BOOK F°GEM <br />by a show of hands that they were in 100% agreement with Mr. <br />Nelson's statement. <br />Commissioner Scurlock asked Mr. Miller if he presently had a <br />contract for the sale of this mobile home park, and Mr. Miller <br />said he did not. <br />Chairman Lyons swore in Arthur Aker, 8775 20th Avenue, who <br />objected to the petition for modification. He cited the <br />promises made at the time he was considering buying a unit at <br />Village Green. He also recalled the lawsuit the residents <br />brought against the condo situation and pointed out that the <br />District Court agreed with them and not Attorney Brandenburg who <br />had said that the zoning was correct and had no bearing in the <br />matter. He proposed that Attorney Brandenburg again was wrong in <br />his opinion that the Board cannot require these improvements to <br />be made, and respectfully requested that the Board deny this <br />petition. <br />Attorney McDonough asked if there were any additional <br />comments from staff, but Chairman Lyons felt that we are now at <br />the point where the Board either agrees with staff or takes issue <br />with their opinion. He, personally, felt that the Board has the <br />right to require these major improvements to be made. <br />Attorney McDonough repeated that the brochures and <br />photographs submitted by the residents are not relevant to this <br />issue. He pointed out that the Board has already heard the <br />County Attorney's..opinion and stressed that his client has a <br />legal right to delete these items as they do not significantly <br />impact the development of the community. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously closed <br />the Public Hearing. <br />33 <br />W <br />_I <br />
