He continued to emphasize <br />that if this property isn't zoned commercial, it will just sit <br />there. <br />In regard to Attorney Sullivan's comments about negotiating <br />the price of the right-of-way in return for commercial zoning, <br />Commissioner Wodtke pointed out that it is illegal for the <br />Commission to contract on a rezoning. <br />Mr. Sullivan noted that this subject property as commercial <br />is worth $100-150,000 per acre, but as residential only about <br />$50,000, and he continued to refute the County Planners' <br />statement that the property can be used feasibly as residential, <br />which he claimed is simply not true. He argued that there will <br />be more traffic problems with twenty residential units than with <br />stores, and he felt the County should rezone this without any <br />requirement that the applicant contribute anything. <br />Commissioner Scurlock asked what Mr. Sullivan's objection <br />was to tracking the site plan along with the rezoning request, <br />and Mr. Sullivan stated that they can sell this property right <br />now, and they are not going to sit and wait and come back a year <br />later. If this is denied, they will just develop the commercial <br />part and let the other piece sit. <br />Chairman Lyons felt they had indicated they had a sale for <br />the property, and Mr. -Sullivan stated they could have, but it <br />collapsed because of the Planners' indication that they would not <br />recommend the rezoning to commercial. <br />Chairman Lyons poin-ted out that no matter what kind of an <br />agreement the Commission would make with the present owners, once <br />the property is rezoned commercial and sold, we would have no <br />further hold on that piece of property. <br />Mr. Sullivan stated they would be happy to put a deed <br />restriction on the property. <br />Commissioner Scurlock continued to stress his problem with <br />paying a developer $85,000 to build a beautiful road in front of <br />his property and then being held to the gun to do more for him. <br />41 900K 60 PnE 4dJ6 <br />
