constraints, etc.; these have not been met, and it has run out. <br />Also in regard to pass-through of the impact fees, Mr. Miller <br />pointed out that when the County changes the rules of the game, <br />the owner cannot always change his rules because of other <br />agreements in leases, etc. <br />Wayne Gearhold, resident in Phase I, stated that their prob- <br />lem started about a year ago at which time he first contacted the <br />Utility Department, and he cannot say enough in praise of the <br />help they have had from Commissioner Scurlock, Administrator <br />Wright, the Utility Department, and all those involved. He <br />believed they all are keeping a close eye on their problems. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously authorized <br />the County Attorney to take whatever steps are <br />necessary to resolve the disputed portions of the <br />Village Green Phase IV franchise, including permis- <br />sion to file a Complaint for Declaratory Relief and <br />also to determine if we have the right to require the <br />entire park to hook up to the County system. <br />SOUTH COUNTY FIRE <br />The Chairman announced that immediately upon this meeting <br />being adjourned, the Board would reconvene as the District Board <br />of Fire Commissioners of the South Indian River County Fire <br />District.
