APR 101985 <br />BOOK 60 F1,E 486 <br />ORDINANCE NO. 85- 35 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, AMENDING CHAPTER 21, <br />ARTICLE XVII, OF THE CODE OF LAWS AND ORDINANCES, ALSO <br />KNOWN AS ORDINANCE 84-71, PERTAINING TO THE VERO <br />HIGHLANDS AREA MUNICIPAL SERVICE TAXING UNIT; PROVIDING <br />FOR REINACTMENT AND REVISION OF SECTION 21-161 TO REVISE <br />THE DESCRIPTION OF REAL PROPERTY INCLUDED IN THE TAXING <br />UNIT; AMENDING THE NAME OF THE UNIT; PROVIDING FOR <br />CODIFICATION; REPEAL OF CONFLICTING PROVISIONS; <br />SEVERABILITY; AND EFFECTIVE DATE. <br />WHEREAS, on October 10, 1984, the Board of County <br />Commissioners enacted Ordinance 84-71, thereby establishing a <br />municipal service taxing unit to provide street lighting for the <br />Vero Beach Highlands Subdivision area; and <br />WHEREAS, the Board desires to amend the boundaries of <br />said MSTU to reflect the inclusion of several large unplatted <br />properties which shall receive a benefit from the street lighting, <br />but which were originally omitted from the property subject to <br />levy. <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />SECTION ONE <br />Section 21-161 of the Code of Laws and Ordinances, <br />originally enacted as Ordinance 84-71, Section 1, is hereby <br />amended and reenacted in its entirety to read as follows: <br />Section 21-161. Creation of Municipal Service Taxing <br />Unit. <br />There is hereby established in Indian River County the <br />Vero Beach Highlands area municipal service taxing unit under the <br />authority of, and with all those powers conferred by, the Consti- <br />tution of the State of Florida and Florida Statutes 5125.01(q)(r). <br />The real property included within the boundaries of this municipal <br />service taxing unit and subject to all provisions hereof is <br />described as follows: <br />The East 1/2 -of Section 35, Township 33 South, <br />Range 39 East, plus all of Section 36, Township 33 <br />South, Range 39 East, plus the West 1/2 of the <br />Northwest 1/4 of Section 31, Township 33 South, <br />Range 40 East, plus all that portion of the <br />Southwest 1/4 of said Section 31 lying West of the <br />Lateral J Canal, together with Unit 1 of the Vero <br />Beach Highlands Subdivision as recorded in Plat <br />Book 5, Page 29 of the Public Records of Indian <br />River County, Florida; all lying and being within <br />Indian River County, Florida. <br />-1- <br />
