BOOK 60 Ft1;E 5O4 <br />Director Keating assured the Board that the mining <br />operations that were approved since the Fischer and Hyatt <br />operations have at least 8 to 10 overburden where the <br />aquifer comes up and felt they have sufficient area. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />passed by a vote of 4-1, Commissioner Bowman <br />dissenting. <br />REQUEST FOR PERMISSION TO SEEK INJUNCTION AGAINST SEBASTIAN <br />ASSOCIATES <br />The Board reviewed the following memo dated 3/28/85: <br />TO: The Honorable Members <br />of the Board of <br />County Commissioners <br />FROM: Robert Keating, AICP REFERENCES: Injunction <br />Planning & Development Director IBMIRD <br />DATE: <br />March 28, 1985 <br />SUBJECT: <br />FILE: <br />REQUEST FOR PERMISSION <br />TO SEEK INJUNCTION <br />AGAINST SEBASTIAN <br />ASSOCIATES <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of April 3, 1985. <br />DESCRIPTION & CONDITIONS <br />In July of 1984, the Planning and Zoning Commission approved a <br />site plan application submitted by Sebastian Associates, owners <br />of Sebastian Lakes, a multi -family residential development <br />lying within the City of Sebastian. Approval was given to <br />change the use of Stuckeys, a tourist/commercial ail <br />facility, located at I-95•and CR 512, to a real estate sales <br />office for the aforementioned condominium complex. <br />In February of 1985, the Code Enforcement Department made a <br />site inspection to determine conformance with the approved <br />plan, a prerequisite to the issuance of a certificate of <br />occupancy. The inspection revealed several discrepancies from <br />the approved plan, the primary one of which was the failure to <br />pave 108th Avenue from C.R. 512 to the south property line of <br />the site; an improvement which had been depicted on the <br />approved site plan. However, on March 5, 1985, staff observed <br />that the facility was being occupied regardless of the lack of <br />a certificate of occupancy. <br />73 <br />
