of Tax Collector Gene Morris, in regard to revising the entire <br />Occupational License Ordinance. <br />Commissioner Bird wished to know what we do to solve this <br />young lady's problem in the meantime, and Attorney Wilson <br />believed it would be possible to prepare something quickly to <br />revise the unconstitutional portion of the ordinance plus the <br />penalty clause. <br />Attorney Brandenburg agreed this should be done, but since <br />it appears there is a clear indication that the residency <br />requirements are unconstitutional, he felt the Board should allow <br />Mrs. Savastano to obtain her license in the meantime. <br />MOTION WAS MADE by Commissioner Bird to authorize <br />the Tax Collector to issue a license to Darlene <br />Savastano and to authorize staff to revise the <br />Occupational License Ordinance for advertisement. <br />Commissioner Bowman believed there is a zoning problem, but <br />Attorney Brandenburg advised that Mrs. Savastano has taken care <br />of the zoning problems, and noted that when a license is issued, <br />she still would have to comply with all zoning requirements. <br />Commissioner Wodtke stated that he would prefer that we <br />revise the Ordinance first and have an opportunity to see how <br />this is addressed in other areas, whether examinations are <br />required, background investigations, etc. <br />Commissioner Bird expressed his feeling that we should <br />authorize issuance of the license since Mrs. Savastano has lived <br />here a year and desires gainful employment. <br />Vice Chairman Scurlock agreed, but felt he would at least <br />like to have a background check made. <br />Attorney Wilson advised that 'this is a requirement of the <br />current ordinance, and Attorney Brandenburg confirmed that <br />although his office's opinion is that the portion of the <br />ordinance regarding residency is unconstitutional, the remainder <br />13 BOOK '� <br />APR 17 1985 <br />
