APR 17 .1985 <br />BOOK 60 F,�cF.5�S . <br />NOW THEREFORE, the parties desire to resolve their <br />differences by entering into this Agreement, forever settling the <br />location and public ownership of Jungle Trail as it transverses <br />the Owners' property and the boundary line of the Owners' <br />property; the parties agree as follows: <br />1. The foregoing recitals are true and correct and <br />incorporated herein as a representation of the parties upon which <br />is Agreement is based. <br />2. County hereby authorizes the County Attorney to prepare <br />and the Chairman of the County commission and Clerk to execute a <br />County Deed in favor of the Owners containing the legal <br />description as set forth in Exhibit "A" of that portion of the <br />roadway as described on the 1976 Maintenance Map, that exists west <br />of the new alignment of the road, and including the following <br />language: <br />"The purpose of this deed is to convey all the right, title <br />and interest of Indian River County in and to the above described <br />property arising by virtue of the filing of that certain <br />Maintenance Map recorded in Official Record Book 9, Page 40, <br />public records of Indian River County, Florida." <br />3. The County shall take all actions necessary to clear the <br />public records of the 1976 Maintenance Map for the length of the <br />Owners' property. The County may file a new Maintenance Map <br />showing the road as realigned according to the legal description <br />set forth in Attachment "B" hereto. <br />4. Simultaneously with the County's actions taken with <br />respect to Paragraphs 2 and 3 above, the Owners shall deed to <br />County, by Warranty Deed, all lands comprising the new <br />right-of-way as set forth in Attachment "B" hereto, together with <br />any releases that may be necessary to clear the property of any <br />mortgages. <br />5. In order to facilitate the realignment of Jungle Trail, <br />the owners will have the new right-of-way surveyed and staked out <br />in a manner as to be plainly visible to County road crews. <br />
