MAY 1 1995 <br />BOOK6Q °��GE 774 <br />Commissioner Bird noted that his position at the last <br />meeting was that we should approve the rezoning, and he has not <br />heard anything today to change his mind one way or the other. He <br />believed that generally a property owner should be allowed to use <br />his property the best way he can unless the use is adverse to the <br />public interest. He does not get the strong feeling that it <br />would have any significant detrimental effect on the wellbeing of <br />the residents of the area if this were.rezoned commercial. To <br />the contrary, he believed if it were done under one site plan, we <br />could provide more adequately for buffering, security, fences, <br />etc. He, therefore, would like to try the same Motion he made at <br />the last hearing on this matter. <br />Attorney Brandenburg noted that the first step would be to <br />change the Land Use Plan designation. <br />MOTION WAS MADE by Commissioner Bird, SECONDED <br />by Commissioner Wodtke, to adopt an ordinance <br />redesignating the subject 1.95 acres from MD -2 <br />to Commercial. <br />Commissioner Wodtke believed when you consider this piece of <br />property In relation to its shape and its location, that it is <br />very important to get the deceleration lane and address the <br />drainage. He felt it is very logical that it will be developed <br />as commercial, which he agreed is the highest and best use of the <br />land. He did not feel it would be a detriment to the area and <br />concurred with Commissioner Bird that we could control it better <br />with a site plan of the entire parcel. <br />Commissioner Bird further stated that he did not anticipate. <br />such a rezoning would have a domino effect or he would have been <br />opposed to it. <br />Commissioner Bowman believed there is a plan to build multi- <br />family on 6th Avenue right across from this property. <br />58 <br />771 <br />i <br />
