DESCRIPTION AND CONDITIONS: <br />BOOK 610 FD:,E Q 29 <br />The applicants, Vincent J. and Gary J. Anthony, request that <br />the Board of County Commissioners vacate a portion of the <br />Replat of Vero Beach Heights. Approximately half of the replat <br />is located on the Anthonys' property, which includes the future <br />site of a low-cost housing project. The remaining portion of <br />the replat is situated on the Indian River County School <br />Board's Clemans Elementary School site. The replat shows no <br />lots, but does depict what appears to be a road right-of-way. <br />No roads exist on the property. <br />The applicants are requesting the plat vacation to clear title <br />on their property so that arrangements can be made to begin <br />construction of their housing project. <br />ALTERNATIVES AND ANALYSIS: <br />Although the replat is not shown on the county tax parcel maps, <br />the replat has never been officially vacated. The Clemans <br />Elementary School site and the housing project site (which <br />received site plan approval on January 10, 1985) occupy most of <br />the area covered by the replat. It is the opinion of staff <br />that the County needs no interest in rights-of-way or easements <br />indicated on the replat. <br />According to Chapter 177.101 of the Florida Statutes, the Board <br />of County Commissioners must ascertain three facts before it <br />approves a plat vacation request. These facts are: <br />1) that the applicant(s) hold fee simple title to the <br />land for which the request is being made, <br />2) that the vacation, if approved by the Board of County <br />Commissioners, will not affect the ownership or right <br />of convenient access of residents within the subdivi- <br />sion. <br />3) that all back taxes on the subject property have been <br />paid. <br />The applicants have submitted deeds to the Planning Department <br />showing that they hold fee simple title to the land in ques- <br />tion. The partial plat vacation would not affect rights of <br />convenient access of any residents. Also, documentation has <br />been submitted by the Indian River County Tax Collector's <br />office certifying that all back taxes on the property have been <br />paid. Thus, all state requirements concerning plat vacation <br />have been met.. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt <br />the attached resolution vacating a portion of the Replat of <br />Vero Beach Heights. <br />34 <br />
