REQUESTED ACTION: <br />Adopt the attached resolution authorizing the Public Works <br />Director and County Attorney to acquire by eminent domain the <br />remaining Lateral "A" right-of-way parcels <br />MOTION WAS MADE by Commissioner Scurlock, <br />SECONDED by Commissioner Wodtke, that the Board <br />adopt Resolution 85-49, declaring the acquisition of <br />certain parcels of property for right-of-way purposes <br />for the extension of Lateral A Road to be a public <br />necessity and authorizing the preparation and <br />prosecution of eminent domain proceedings. <br />Under discussion, Commissioner Bowman wondered why we <br />haven't moved over to Power Line Road since we are havingso much <br />trouble condemning property along Lateral A Road. <br />Assistant County Attorney Chris Paull explained that they <br />also are working on Power Line Road as the Board originally <br />authorized right-of-way to be obtained for both of these roads. <br />Public Works Director Jim Davis explained that Lateral A <br />Road was done first because it is an extension of the existing <br />Lateral A Road south of CR -510 and is a direct connection to the <br />new school there. He confirmed that when Lateral A is completed, <br />it will divert traffic from Power Line Road. <br />Chairman Lyons felt•it was totally unfair for some people to <br />hold us up while other people are perfectly willing to have their <br />property improved and take the advantage. He suggested a fairer <br />method might be a road assessment situation. On one line we <br />would show the value of the property on a road and when we put <br />out the assessment, we debit the value of the property; and for <br />those who have donated the property, we credit the value of the <br />property.
