MAY s i90 s BOOK 0 rvF 859 <br />Commissioner Bird asked if we will have an opportunity to <br />develop the ordinance after the mapping has been done and after <br />we have seen what actual effect it has on our coastline. <br />Commissioner Wodtke advised that the control line depends <br />upon whether it is set under the rule-making procedures. If it <br />is, then anything.along that line goes to the Governor and the <br />Cabinet for approval. An interim line is not set under the <br />rule-making procedures; it is policy se.t outside. He reported <br />that the Beach Preservation and Restoration Committee discussed <br />this at great length after the Governor was here to inspect the <br />damage done by the Thanksgiving Day storm. The concern the <br />Committee had was that the Governor and Cabinet had assigned a <br />task force at that time to study all these areas for potential <br />problems and they wondered what those results would be. Another <br />concern was that any approval for the line to move eastward would <br />have to go to Tallahassee for approval. Commissioner Wodtke <br />reported that Brevard County moved the construction setback line <br />back 25 feet after the Thanksgiving Day storm on a tentative <br />basis and asked the DNR to come in and do an emergency <br />evaluation. They did, and, basically, that line moved 110-220 <br />feet further west of the line, and in some places, the line is <br />west of AIA, but it is still tentative. He pointed out that <br />this Commission has already passed a resolution requesting a <br />study every three years, not every 5 years. In checking their <br />priorities, we were told that Indian River County was designated <br />sixth, but it since has been indicated it may be 1989 or even <br />1990 before they can even get to it. Commissioner Wodtke stated <br />that was the first time the Committee became aware that we could <br />apply for a tentative line, and felt it was new and confusing, <br />especially with respect to jurisdictional control. <br />Administrator Wright advised that major legislation is <br />expected which will significantly impact the setback control <br />lines and the coastline. <br />64 <br />_I <br />
