MAY 15 1985 BOOKG,- 934 <br />During periods of emergency, such as hurricanes or severe storms, in <br />order to protect life or property, provisions of this ordinance may <br />be temporarily suspended by petition to, and approval of, the Board <br />of County Commissioners. <br />25 Y. EXCAVATION OF CANALS AND WATERWAYS. <br />1. Limitations. <br />The excavation of navigable canals or waterways from submerged lands <br />in Class II waters, aquatic preserves or the boundaries of the <br />Pelican Island National Wildlife Refuge is prohibited. The exca- <br />vation of any canal or waterway shall not be for the purpose of <br />obtaining fill. Maintenance dredging shall only be permitted in <br />compliance with all applicable regulations of the State of Florida <br />and the Army Corps of Engineers, as well as the receipt of all <br />requisite permits. <br />2. Minimum Width and Depth; Environmental Protection. <br />When permitted, canals and waterways shall be the minimum width <br />necessary to accomplish the purpose for which they are constructed. <br />An applicant desiring to construct a canal or waterway must affirma- <br />tively show a design that will prevent stagnation and eutrophication <br />of the system, provide sufficient flushing and maintain the ambient <br />water quality. <br />
