MAY 2 2 1985 <br />BOOK 61 FA - 1 <br />Commissioner Scurlock felt that what we would be doing here <br />is basically establishing a concession stand on County property <br />and he was not sure what precedent this would be setting. <br />Commissioner Bird pointed out that the Parks & Recreation <br />Committee recommended approval of the agreement since they felt <br />that sailboarding is a form of recreation and this would not be <br />just a hot dog stand type of establishment. He advised that <br />there is an escape clause in the lease which allows us to get out <br />of the agreement if we are dissatisfied with their operation. <br />The Sailboard Center has also released the County from any <br />liability with respect to insurance, etc. <br />Intergovernmental Relations Director Tommy Thomas noted that <br />we have other agreements with firms which rent umbrellas, rafts, <br />etc. and though he was originally opposed to this, Sailboard <br />Center made a good presentation and convinced him this would be. <br />different. Apparently sailboarding is becoming very popular and <br />he agreed that we should give it a try. <br />Attorney Brandenburg explained that the contract is for one <br />1 <br />year and is cancellable by the County on a 60 -day notice. <br />Commissioner Bowman believed that the $10 fee was <br />insufficient, and Commi.ssioner Scurlock felt a $100 fee would be <br />more appropriate. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously approved the <br />following agreement between Indian River County and The <br />Sailboard Center with the fee changed from $10 to $100, <br />and authorized the Chairman's signature. <br />14 <br />
