JUN 5 1985 <br />BOOK 61 F,, 147 <br />AGREEMENT RELATING TO THE PROVISION <br />OF WASTEWATER TREATMENT SERVICES TO <br />VILLAGE GREEN, PHASE IV (WEST) BY <br />INDIAN RIVER COUNTY, FLORIDA <br />WHEREAS, THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, on September 10, 1980, approved Resolution <br />No. 80-88, granting a water and sewer franchise to FLORIDA - <br />ATLANTIC ASSOCIATES, a New York general partnership; and <br />WHEREAS, FLORIDA -ATLANTIC ASSOCIATES has operated a <br />water and sewer system serving Phase IV of a development known as <br />VILLAGE GREEN to the date of this Agreement; and <br />WHEREAS, FLORIDA -ATLANTIC ASSOCIATES now proposes to <br />sell its development to REALCOR-VERO BEACH ASSOCIATES, a <br />Florida general partnership, and assign and transfer any and all <br />rights under Resolution No. 80-88 to the purchaser; and <br />WHEREAS, a dispute has arisen between INDIAN RIVER <br />COUNTY; the current property owner, FLORIDA -ATLANTIC <br />ASSOCIATES; and the prospective buyer, REALCOR-VERO BEACH <br />ASSOCIATES, regarding: <br />(a) The County's right to require the development to <br />connect to the combined Indian River County public water and sewer <br />system, and <br />(b) In the event the development does connect, what <br />charges and fees would be imposed by the County and payable by the <br />owners of the development. <br />WHEREAS, the COUNTY and REALCOR-VERO BEACH <br />ASSOCIATES, hereinafter referred to as "DEVELOPER," now <br />desire to resolve the dispute, pursuant to this Agreement, <br />contingent upon DEVELOPER's acquisition of the project. <br />THIS AGREEMENT made this 5th day of June , <br />1985, by and between INDIAN RIVER COUNTY, FLORIDA, a political <br />subdivision of the State of Florida, hereinafter referred to as <br />"COUNTY" and REALCOR-VERO BEACH ASSOCIATES, a general <br />partnership authorized to conduct business in the State of <br />Florida, hereinafter referred to as "DEVELOPER." <br />91 <br />
