r JUfl 5 195 <br />BOOK 61 F't1GE <br />WASTEWATER SERVICE AGREEMENT <br />THIS AGREEMENT made this 20th.day of May , <br />1985, by and between INDIAN RIVER COUNTY, a political <br />subdivision of the State of Florida, hereinafter referred to as <br />"County," and INDIAN RIVER ASSOCIATES, LTD., a Florida limited <br />partnership, hereinafter referred to as "Customer." <br />WITNESSETH: WHEREAS, the City of Vero Beach and <br />County entered into a temporary wastewater capacity transfer <br />agreement on the 6th day of July, 1984, transferring 100,000 <br />gallons per day of wastewater capacity from the South County <br />Mainland wastewater service territory to the County's Hospital <br />Node; and <br />WHEREAS, <br />Customer is <br />constructing <br />an office/medical <br />complex on property <br />within the <br />Hospital Node <br />in the water and <br />sewer service area of <br />the County <br />and is in need <br />of sewer service; <br />and <br />WHEREAS, the County is not in a position, at this time, <br />to supply sewer service to Customer, and desires to prevent the <br />proliferation of private package wastewater treatment plants and <br />septic sewage disposal systems; and <br />WHEREAS, Customer and County desire that the City <br />service Customer with a limited amount of sewer service on a <br />temporary basis; and <br />WHEREAS, it is now the intention of the County to <br />formally authorize the use of a portion of the temporary <br />wastewater capacity, under the following terms and conditions: <br />The parties agree as follows; <br />1. It is understood between the parties that this is a <br />5,000 gallon -per -day temporary allocation of wastewater capacity, <br />and the County does not represent that the County, City or any <br />other facility will be available for Customer for permanent <br />service to the site. Consequently, the County will require <br />Customer to provide assurances of its ability to have installed <br />a private septic sewage disposal system, pursuant to applicable <br />laws and ordinances. <br />2. Customer has site planned a site where a possible <br />septic sewage disposal system could be located, and agrees to <br />have the system installed in accordance with all applicable laws <br />
