M <br />Commissioner Bird brought up traffic impact and the require- <br />ment that a node "shall not downgrade the level of service." He <br />asked if this would be specifically from Level C to Level D or <br />just require that a node would not throw the traffic into a worse <br />level. <br />Discussion followed as to what level should be set out, and <br />Attorney Brandenburg agreed the language should be changed to be <br />consistent with the Comprehensive Plan - i.e., average annual <br />level of Service C, and Level D during the peak season. <br />The Chairman asked if anyone present wished to be heard. <br />Attorney Steve Henderson came before the Board representing <br />Adult Community Total Services, Inc. (ACTS) whom the Board will <br />be hearing next week. He noted that they applied for a neighbor- <br />hood node designation on the northwest corner of 74th Ave. and SR <br />60 two months ago and found themselves tracking this new ordi- <br />nance as they went. Attorney Henderson continued that obviously <br />this ordinance causes them some problems if it is interpreted so <br />as to require a measurement between two existing nodes either <br />along both sides of Route 60 or if it is interpreted to mean that <br />there is an existing node boundary at 1-95 right now. He did not <br />believe a boundary has been officially adopted for the 1-95/Rt. <br />60 node, but staff has said that there is such a boundary and <br />that it was created by the rezoning for the bank at 79th Avenue <br />on the south side, which happens to be about .7 of a mile from <br />the 74th Avenue location. On the other side of that is the 66th <br />Ave. neighborhood node for Vista Plantation and that happens to <br />be .9 of a mile so the variance provision would apply. Attorney <br />Henderson stressed that if you interpret this as meaning the node <br />boundary at 1-95 is already established, then it will mean that <br />not only will this node at 74th Ave. be knocked out, but there <br />will be no more neighborhood nodes on SR 60 from the City limits <br />to a mile beyond the west boundary of the 1-95 node. <br />Attorney Henderson pointed out that their proposed node <br />would be to serve only the needs of their non-profit life care <br />47 <br />BOOK I F',GE <br />� JUN 5 1985 J <br />
