JUN 5 1.905 BOOK <br />ON MOTION by Commissioner Wodtke, SECONDED by. <br />Commissioner Scurlock, the Board unanimously <br />adopted Resolution 85-60 approving the final <br />assessment roll for the construction of the <br />40th Avenue cul-de-sac. <br />RESOLUTION NO. 85-60 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, PROVIDING FOR CERTAIN PAVING <br />AND LANDSCAPING IMPROVEMENTS TO 40TH <br />AVENUE AS IT INTERSECTS 14TH STREET; <br />PROVIDING FOR THE TOTAL COST OF THE <br />PROJECT TO BE ASSESSED AGAINST BENEFITED <br />PROPERTIES, METHOD OF ASSESSMENT, NUMBER <br />OF ANNUAL INSTALLMENTS AND LEGAL <br />DESCRIPTION OF THE AREA SPECIFICALLY <br />BENEFITED. <br />WHEREAS, Indian River County received a petition from those <br />property owners located along 40th Avenue from 14th Street to 12th <br />Street requesting the County. close 40th Avenue at the 14th Street <br />intersection and simultaneously construct a cul-de-sac; with the <br />property owners volunteering to pay by special assessment 100% of <br />the costs of the project, and <br />WHEREAS, the Board of County Commissioners at a regularly <br />scheduled public meeting considered the petition of the land owners <br />and determined that the petition met the requirements of Ordinance <br />No. 81-27, and by unanimous vote decided to proceed with the <br />project, and <br />WHEREAS, the Board of County Commissioners on July 18, 1984, <br />after proper notice and publication of ..their intent, adopted• <br />Resolution No. 84-50 providing for the closing and abandonment of a <br />60 -foot portion of 40th Avenue to enable* the construction of a <br />cul-de-sac, and <br />WHEREAS, the Board of County Commissioners, at a subsequent <br />meeting of the Commission, after receiving estimates from <br />contractors of the cost of construction, awarded contracts for the <br />performance of the work, and <br />80 <br />
