BOOK '61 F",;E 127 <br />Attorney Brandenburg clarified that the Board authorized his <br />office to work on a negotiated settlement of some disputes that <br />exist between the County and the current owner of the franchise <br />of Village Green, and they have accomplished that with respect to <br />Phase V of the development, Village Green West, in that they have <br />negotiated a purchase arrangement and the new purchaser is <br />willing to accept this Resolution and enter into this agreement, <br />which he believed will resolve our wastewater dispute, and also, <br />hopefully, the litigation on-going re the gazebo and other <br />issues. The County Attorney recommended that the Board approve <br />the Resolution and the agreement with two minor changes to the <br />Resolution. <br />Commissioner Scurlock wished to add that Mr. Nelson and the <br />property owners have been outstanding in their cooperation and <br />the proposed purchasers were extremely cooperative as well. <br />Commissioner Bird asked how the franchise is related to the <br />improvements. <br />Commissioner Scurlock explained that the basic problem was <br />the existing owners, as well as any future purchaser, had a <br />difficult time coming up with the new $1,200 impact fees; so, <br />through the agreement a vehicle will be provided whereby the new <br />impact fees do not have to be paid all up front but rather a <br />certain amount of taps would be guaranteed in the first year and <br />then as new units turn over and new leases are entered into, <br />those impact fees can then be collected and passed on. <br />Commissioner Bird inquired as to the understanding about the <br />gazebo, etc., and Attorney Brandenburg informed the Board that a <br />representative of the new owners is here today, and they have <br />indicated they intend to build all the structures essentially <br />shown on the site plan. <br />Commissioner Scurlock commented that this was not extracted <br />from them; they offered to do it. He felt these improvements <br />would improve their relations with the community. <br />86 <br />
