Resolution 85-41A was amended at the request of <br />Judge Vocelle and Judge Smith to prevent Weekend Work Program partici- <br />pants who are not actually incarcerated at the jail from receiving extra <br />gain time credit for participation in a work program. Under the amended <br />resolution, prisoners sentenced to the Weekend Work Program may continue <br />to receive 5 days per month credit as required under Florida Statutes _ <br />5951.21. However, such prisoners shall not be eligible for discre- <br />tionary gain time as provided within Florida Statutes §951.21. <br />I understand that representatives of the Public Defender's office <br />and State Attorney's office may appear at the hearing to comment on this <br />amendment. If you have any questions or comments on this matter, please <br />do not hesitate to contact me. <br />Bruce Smith, Public Defenders Office, commended the <br />Commission for establishing the successful Weekend Work Program, <br />but expressed concern about the proposed amendment to make <br />prisoners under the program ineligible for discretionary gain <br />time. He felt that if a person is sentenced to 6 months <br />straight time, he has the choice of whether to just sit in jail <br />or work it out in the Gain Time Program, where the better they <br />work, the more time they gain. However, a person sentenced to 6 <br />months in the Weekend Work Program must work every weekend for <br />almost two years. He felt that after awhile they would lose <br />their incentive to work every weekend with no other reward than <br />staying out of jail. He felt that pretty soon people would <br />realize that it is a better deal to just do the six months in <br />jail. For all purposes, they are prisoners, and to say that we <br />are now going to treat them not as prisoners, but as weekend <br />50 <br />
