FF" -- <br />JUN 1935 <br />BOOK 6-� F'°.F 2� 8 <br />Assistant County Administrator Sonny Dean believed that the <br />proposed wording might result in future problems with respect to <br />alternative sentencing, and recommended further investigation <br />into the possibility of this creating a problem for this or <br />future programs. <br />Assistant County Attorney Jim Wilson noted that the judges <br />have already addressed their concerns by amending their standard <br />order to specifically state that individuals in the Weekend Work <br />Program are not entitled to gain time under the provisions of the <br />Resolution. <br />Attorney Brandenburg stated that the judges are saying that <br />the individuals sentenced to the Weekend Work Program are not <br />going to get gain time, period. It is up to the judge to decide <br />how he does his order and it is up to the County Commission to <br />establish the guidelines for gain time for sentenced prisoners. <br />Basically, what has happened is that the judges have entered an <br />order to get around the Resolution. <br />Commissioner Scurlock felt that the real incentive is not <br />having to spend time in jail. <br />ON MOTION by Commissioner Wodtke, SECONDED by <br />Commissioner Bird, the Board by a vote of 4-1, <br />Commissioner Scurlock dissenting, moved to table <br />this issue for further investigation as recommended <br />by staff. <br />RESOLUTION REQUESTING STATE TO REESTABLISH THE COASTAL <br />CONSTRUCTION CONTROL LINE IN INDIAN RIVER COUNTY <br />Chairman Lyons felt that all the proposed resolution states <br />is that we are in agreement with getting this started as soon as <br />possible. <br />Commissioner Wodtke reported that the Beach Preservation and <br />Restoration Committee have no objection to the proposed <br />resolution as written.
