DREDGE & FILL PERMIT APPLICATION FILE NO. 31-105979-4 -" <br />(After the fact) <br />APPLICANT: Robert F. & Virgina A. Reed <br />WATERWAY & LOCATION: Sebastian River, Section 25, Township <br />30S, Range 38E, Ercildoune Heights <br />Subdivision <br />WORK & PURPOSE: The applicant is seeking an after the fact <br />permit for a 184 foot long concrete block retaining wall. The <br />retaining wall was built to keep the applicant's lawn and soil <br />from washing into the adjacent waterway. <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />The conservation & Coastal Zone Management Element of <br />the Indian River Comprehensive Plan; <br />Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region; and <br />The Hutchinson Island Resource Planning & Management <br />Plan. <br />- The Code of Laws and Ordinances of Indian River County <br />While the retaining wall has produced no significant adverse <br />impacts to the aquatic environment, this project is presently <br />under review for violation of Sections 6(A) and 29(b)(1); <br />Appendix A of the Indian River County Code of Laws and Ordi- <br />nances. These Sections of the Code state that in the RS -6 <br />Single -Family Residential District, any construction work -must <br />be authorized through the County permitting process. A build- <br />ing permit for the retaining wall was not originally obtained <br />by Mr. & Mrs. Reed. - <br />It has been brought to the attention of staff by the Ercildoune <br />Heights Homeowners Association that there is a concern as to <br />the location of a portion of the wall. The property owners <br />association claim the wall encroaches four inches into their <br />property while the Reed's dispute this claim.
