He assured Commissioner Bird <br />that he is confident that the low bidder can handle the work. <br />MOTION WAS MADE by Commissioner Bird, SECONDED by <br />Commissioner Wodtke, that the Board approve staff's <br />recommendation and award the construction bid for the <br />MGD West Regional Wastewater Treatment Plant to the low <br />bidder, Metro Equipment and Construction Assoc., Inc., <br />in the amount of $1,374,600; for completion within 180 <br />days; and authorize the Chairman's signature. <br />Under discussion, Director Pinto explained that the <br />completion time is part of the contract and there is a penalty in <br />the specifications. He believed we may have to extend the period <br />of time for construction simply because both of the contractors <br />stated that if they were held to that time, they just would put <br />in the cost of the penalty. So we expanded the actual time <br />within the contract and gave them a penalty of $150 a day; and, <br />if they think that it is going to take three months over and <br />above the contract time, they put that into the bid. <br />Attorney Brandenburg asked Director Pinto whether, in that <br />case, a change order could be negotiated with them immediately, <br />but Director Pinto stated that was not the case here because we <br />had extended the time. <br />32 <br />
