M <br />DESCRIPTION AND CONDITIONS: <br />The County's subdivision ordinance (NO. 83-24) was adopted on <br />July 20, 1983. Since that time, staff has realized the need to <br />modify and add to some of the existing technical surveying and <br />platting requirements, so that these requirements may be <br />brought into full conformance with State standards. Also, some <br />ordinance modifications are needed to allow for more appro- <br />priate application of requirements to certain types of <br />development where land is subdivided. The 12 proposed <br />amendments represent an updating and "fine-tuning" of the <br />existing ordinance. <br />ALTERNATIVES AND ANALYSIS: <br />The proposed amendments have been formulated, reviewed, and <br />supported by the County Attorney's Office, Planning and <br />Development Division, and the Public Works Division. At their <br />June 13, 1985 meeting, the -Planning and Zoning Commission <br />recommended that the Board of County Commissioners adopt the <br />attached ordinance, amending the subdivision ordinance. <br />The following is a section by section analysis of each proposed <br />amendment. <br />1) SECTION 1. This amendment broadens the existing <br />definition to include improved lands, blocks, tiers, <br />sites, and units. This will more specifically apply the <br />ordinance to the subdivision of land in developments that <br />are not designed as single-family residential develop- <br />ments. This amendment also excludes the creation of a <br />private street from the definition of a subdivision. The <br />creation of private streets is covered in section 11. <br />2) SECTIONS 2-5. These amendments reflect the changes needed <br />to bring the County's platting and surveying standards <br />into complete conformance with State standards, as well as <br />technical standards observed by the Public Works Division. <br />3) SECTION 7 AND 8. These amendments reflect the changes <br />needed to allow the platting of land condominium and <br />townhouse type developments. The ordinance presently <br />applies lot dimension and direct vehicular access <br />requirements to all platted lots. These requirements <br />reasonably apply to single-family type subdivisions, <br />but not to townhouse and land condominium subdivisions. <br />Individual lots in these types of developments define <br />building units, and usually have indirect access tou <br />streets through common parking areas and driveways. It <br />has been the County's policy to allow these types of <br />developments to_be platted, by waiving lot dimension and <br />direct access requirements. These amendments would bring <br />the ordinance in line with present County policy. <br />4) SECTION 9. This amendment adds a sentence to the existing <br />right-of-way and street width requirements. It would <br />allow the lessening of right-of-way and street pavement <br />width for private one-way streets. Some designs in <br />commercial subdivisions utilize one-way streets, yet are <br />presently required to establish 50 foot rights-of-way for <br />such streets. Under the proposed amendments, private <br />one-way streets would have to be designed in accordance <br />with the manual of uniform standards and be approved by <br />both the Public Works and Community Development directors. <br />35 <br />L 17 1985 <br />BOOK 61 F,�GE 5?6 <br />
