Goetzfried <br />Chief, Current Development Section <br />FROM: Stan Boling REFERENCES: <br />A4 4 Staff Planner <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of July 17, 1985. <br />DESCRIPTION AND CONDITIONS: <br />On July 18, 1979, -at a properly. noticed public hearing, the - <br />Board of County Commissioners moved unanimously to vacate all <br />but the south 40 feet of the "Replat of Grenview Gardens"; the <br />south 40 feet being Oslo Road right-of-way. <br />However, a resolution reciting the plat vacation action was <br />never drafted, adopted, and recorded. Therefore, the vacation <br />action was not effective pursuant to section 177.101(5) of the <br />Florida Statutes. The property, located west of 27th Avenue on <br />the north side of Oslo Road, is the site of the approved Oaks <br />Paradise Mobile Home Park. <br />The property owner, Howard P. -Clark, is now requesting that a <br />resolution be adopted, effecting the plat vacation. <br />ALTERNATIVES AND ANALYSIS: - <br />At the July 18, 1979 meeting, the Board of County Commissioners <br />found that Mr. Clark was the fee simple owner of the property <br />involved, that all taxes on the property had been paid, and that <br />the vacation would not affect the ownership or right of convenient <br />access of any person owning other parts of the subdivision. <br />These findings are still valid as applied to the property <br />involved. Adoption of the attached resolution would effect the plat <br />vacation. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt <br />the attached resolution, vacating all but the south 40 feet of <br />the "Replat of Grenview Gardens". <br />44 <br />
