24 1985 <br />BOOK 61 Fact 673 <br />decrease the necessity for euthanasia of the pets as he felt if <br />that were true, it would be a valid reason for consideration of a <br />variance. <br />Mrs. Carlson confirmed that since they will have more <br />capacity at the new facility, it will decrease the need for <br />euthanasia to some extent. She further informed the Board that <br />they are operating under a tremendous handicap lately - they have <br />sold their property and won't be leasing it back until they <br />actually move; so, that will be an additional expense. <br />Vice Chairman Scurlock asked Attorney Vitunac if he felt <br />this case is unique enough to differentiate under law between <br />this situation and general developers. <br />Attorney Vitunac felt it might be appropriate to grant this <br />request with the understanding that Planning Director Keating <br />will look into this whole situation re some way to make it easier <br />to get a variance. Possibly this case could be put in a new kind <br />of structure so it wouldn't set a precedent for people who run <br />out of money. <br />Commissioner Bird expressed his inclination to help the <br />Humane Society, but did not feel we can be too open handed. He <br />believed we could set some timetable for the completion of the <br />landscaping requirements, but not a year. <br />Commissioner Wodtke concurred that he also would like to <br />help but was concerned about setting a precedent. He felt sure <br />the Humane Society understood when they had their site plan <br />approved, that in order to get a C.O., they would have to <br />complete that site plan. <br />Discussion ensued as to possible solutions to enable the <br />Humane Society to get their facility into operation, and <br />Commissioner Bird suggested the Humane Society take their <br />landscaping plan to a local landscape company and get a firm <br />price for the portion remaining to be completed; then post a bond <br />with the county for that amount, and possibly we could give them <br />60 or 90 days to get those improvements in place. <br />28 <br />
