Environment <br />The subject property is not designated as environmentally sensi- <br />tive nor is it in a flood -prone area. <br />r7-; l;f-;-� <br />A County watermain runs along the north side of Oslo Road. <br />County wastewater facilities are not available. <br />RECOMMENDATION <br />Based on the above analysis, including the Planning and Zoning <br />Commission's recommendation, staff recommends that 27 acres be <br />redesignated from LD -2 to MXD and that 28 acres be rezoned from <br />C-1, Commercial District, to CH, Heavy Commercial District. <br />Planner Shearer explained that this request came about late <br />last fall when the Planning Department submitted a request to <br />downzone 70 acres on the south side of Oslo Road from C-1 to <br />single family. When the Planning & Zoning Commission considered <br />that request, they agreed to recommend approval for property <br />lying east of 12th Avenue, but instructed staff to take a more <br />detailed look at the property west of 12th Avenue because they <br />did not feel that should be rezoned to single family. After <br />further analysis, staff concurred and agreed it should be <br />designated MXD because of the mixture of uses and the difficulty <br />of establishing a predominant use. In January, Attorney O'Haire <br />filed a rezoning request and Comprehensive Plan amendment request <br />on behalf of several property owners in the area to redesignate <br />to MXD and rezone to M-1 restricted industrial. Staff went along <br />with the MXD and recommended including some additional property <br />so we would have a contiguous area. Staff, however, was not <br />ready to recommend approval of M-1 and requested they modify the <br />request to CH, heavy commercial, which they agreed to do. Staff <br />and the Planning & Zoning Commission are recommending approval. <br />The Vice Chairman opened the Public Hearing and asked if. <br />anyone wished to be heard in this matter. <br />Helen Ruth Cooper, 4707 39th Avenue, stated she would not be <br />in opposition to the rezoning if she could be assured that it <br />would not affect Coopers Temple Church of God in Christ and the <br />ability to add or expand the church, move it to another site in <br />40 <br />600K 1 F,vF. 8'-' 7 <br />�I U G 211985 J <br />
