K a gCP ACCESS EASEMENT FOR <br />Planning & Develo, ent Director SHORELANDS WEST <br />.SUBDIVISION <br />FROM: Stan Boling .�15, REFERENCES: <br />Staff Planner <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of September 18, 1985. <br />DESCRIPTION AND CONDITIONS: <br />Shorelands West is a proposed 13 lot subdivision of ±9.43 acres, <br />located on the west side of S.R. A -1-A across from the <br />Smuggler's Cove subdivision. Because the subject property has <br />1,000 feet of generalized river shoreline, section 10(r) of the <br />subdivision ordinance requires the dedication and improvement of <br />a 25' public access easement connecting S.R. A -1-A to the river. <br />The Board may waive this requirement in lieu of a dedication of <br />the fair market value of such an easement. <br />At theirregular meeting of August 22, 1985, the Planning and <br />Zoning Commission granted conditional preliminary plat approval <br />to Shorelands West Subdivision. The condition stated that prior <br />to the issuance of a land development permit, the developer must <br />obtain approval from the Board of County Commissioners to <br />dedicate the fair market value of a public access easement in <br />lieu of an actual easement dedication. <br />The owner, Shoreland Development, Inc., Roger Wheelwright, <br />president, is now requesting Board approval to accept a <br />$1,000.00 dedication to the park development fund at the time of <br />final plat approval to satisfy the water access requirement <br />stated in section 10(r) of the subdivision ordinance. <br />ALTERNATIVES AND ANALYSIS: <br />The Attorney's Office has verified that the owner could satisfy <br />the access easement requirement by dedicating an easement over <br />Tract "A" (see attachments #3 and #4) . The actual area of the <br />easement could be as small as 25' X 201, if located in that <br />portion of Tract "A" nearest S.R. A -1-A.
