ATTACHMENT #2 <br />Action filed by the City of Palm Bay against Ranger in August, 2010. That matter does remain pending in <br />the circuit court of Brevard County, Case No. 10CA045316, despite a lack of any activity by the City of . <br />Palm Bay over the past 2 years. The suit relates to allegations of latent defects in the work Ranger <br />performed on Malabar Road under a contract with Brevard County that was completed and accepted by <br />the County in 2001. Responsibility for Malabar Road was later transferred to the City of Palm Bay who <br />subsequently obtained an assignment of the County's contract rights against Ranger and brought the <br />current action. Ranger denies that the suit was timely filed and any defect, latent or otherwise, exists in <br />the work performed.
