Keatin , AIS PRELIMINARY*PLAT <br />Planning & Devel pmen Director' APPROVAL OF OLD SUGAR <br />MILL ESTATES UNIT 5 <br />SUBDIVISION <br />FRONhan Boling REFERENCES: <br />,Q• .•Staff Planner <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of September 25, 1985. <br />DESCRIPTIONS AND CONDITIONS: <br />At their regular meeting of May 23, 1985, the Planning and <br />Zoning Commission, in -accordance with the staff's <br />recommendation, attached a condition to the preliminary plat <br />approval granted for Old Sugar Mill Estates Unit 5. The <br />condition required a dedication of right-of-way 50' wide along <br />the project's 12th Street frontage. The condition is necessary <br />to bring the plat into conformance with the Thoroughfare Plan <br />and subdivision ordinance. <br />On May 24, 1985, attorney Bill Caldwell, on behalf of the <br />owner/ applicant, Ralph W. Sexton, appealed the right-of-way <br />dedication -condition. <br />On June 26, 1985, the Board of County Commissioners considered <br />this appeal. At that time, the Board continued consideration of <br />the appeal until ~the September 25, 1985 Board meeting. The <br />appeal was continued to allow time for the County to hold a <br />workshop on right-of-way acquisition. It was staff's opinion <br />that the Board could better act on the appeal after holding such <br />a workshop and forming a policy or policies regarding the <br />implementation of the Thoroughfare Plan and acquisition of <br />right-of-way along roadways bordered by canals. <br />ALTERNATIVES AND ANALYSIS: <br />Many of the main roads in the county are bordered by canals and <br />canal rights-of-way. The presence of the canals causes problems <br />in equitably implementing the Thoroughfare Plane and applying <br />subdivision right-of-way requirements, since additional <br />right-of-way is only required from property owners on one side <br />of a street. The condition attached to the Old Sugar Mill <br />Estates Unit Five preliminary plat approval, and the subsequent <br />appeal of that condition, exemplifies the right-of-way problems <br />encountered in such situations. <br />63 <br />
