SCHEDULE 2 <br />PROPERTY SPECIFIC PROVISIONS <br />1. [IF APPLICABLE] Disclosure of Information on Lead Based Paint and Lead Based Paint <br />Hazards. Every purchaser of any interest in residential real property on which a residential <br />dwelling was built prior to 1978 is notified that such property may present exposure to lead from <br />lead based paint that may place young children at risk of developing lead poisoning. Lead <br />poisoning in young children may produce permanent neurological damage, including learning <br />disabilities, reduced intelligent quotient, behavioral problems, and impaired memory. Lead <br />poisoning also poses a particular threat to pregnant women. The seller of any interest in <br />residential ,real property is required to provide the buyer with any information on lead-based <br />paint hazards from risk assessments or inspections in the seller's possession and notify the buyer <br />of any known lead-based paint hazards. A risk assessment or inspection for possible lead based <br />paint hazards is recommended prior to purchase. The foregoing disclosure is made in <br />accordance with applicable federal law. <br />2. [IF APPLICABLE] Property. This is an agreement to purchase and sell land located in <br />County, consisting of [developed residential lots] [approximately <br />acres of raw land], and all rights, privileges, easements and interests appurtenant thereto <br />(collectively, the "Property", and one or more lots being referred to as a "Lot" or "Lots") more <br />particularly described on Exhibit A. The Lots are part of Subdivision (the <br />"Subdivision"), and are shown as Lots through inclusive and on the Plat of <br />Subdivision, recorded in Plat Book , Page , of the Public Records of <br />County, (the "Plat") referenced on Exhibit A <br />3. [IF APPLICABLE] Declaration of Planned Community. <br />(a) Buyer acknowledges that: (i) the Subdivision is subject to the terms and <br />conditions of that certain [COMPLETE NAME OF DECLARATION] of, as recorded in Official <br />Records Book , Page , of the Public Records of County, <br />(the "Declaration"); and (ii) the Subdivision has a mandatory homeowners association, <br />, a non-profit corporation (the "HOA"). <br />(b) At Closing, Seller shall: (i) assign to Buyer all of its rights as "Declarant" under <br />the terms of the Declaration, pursuant to the Assignment and Assumption of Declarant's Rights <br />attached hereto as Exhibit ; and (ii) cause any Seller -appointed directors of the HOA to <br />resign, upon which Buyer shall appoint replacement directors of the HOA. <br />(c) Seller has previously conveyed by quit -claim deed to the HOA, Tracts <br />as shown on the Plat. <br />(d) Buyer shall be solely responsible for all HOA dues and assessments assessed <br />against the Property after Closing, including any dues and assessments imposed after Closing <br />that apply to any period prior to Closing. <br />MIAMI 2957652.8 79037/33274 <br />
