<br />This policy does not insure against loss or damage (and the Company will not pay costs, attorneys' fees or expenses)
<br />which arise by reason of:
<br />1. Defects, liens, encumbrances, adverse claims or other matters, if any created, first appearing in the Public
<br />Records or attaching subsequent to the Effective Date but prior to the date the proposed Insured acquires for value of
<br />record the estate or interest or mortgage thereon covered by this Commitment.
<br />2. Any encroachment, encumbrance, violation, variation, or adverse circumstance affecting the Title that would
<br />be disclosed by an accurate and complete land survey of the Land. The term "encroachment" includes encroachments
<br />of existing improvements located on the Land onto adjoining land, and encroachments on the Land of existing
<br />improvements located on adjoining land.
<br />3. Rights or claims of parties in possession.
<br />4. Construction, Mechanic's, Contractors' or Materialmen's lien claims, if any, where no notice thereof appears
<br />of record.
<br />5. Easements or claims of easements not shown by the public records.
<br />6. General or special taxes and assessments required to be paid in the year 2016 and subsequent years.
<br />7. Reservations in favor of the State of Florida, as set forth in the deed from the Trustees of the Internal
<br />Improvement Fund of the State of Florida, recorded at Deed Book 79, Page 40. However, the right of entry and
<br />exploration associated with the oil and mineral reservations has been released by Sec. 270.11, F.S.
<br />8. Restrictions, conditions, reservations, easements, canals, ditches, rights of way and other matters contained
<br />on the Plat of Indian River Farms Company Subdivision, as recorded in Plat Book 2, Page 25, Public Records of St.
<br />Lucie County, Florida.
<br />In accordance with Title 42 United States Code, Section 3604, any covenants, conditions or restrictions referred to
<br />herein, which indicate any preference, limitation or discrimination based on race, color, religion, sex, handicap, familial
<br />status or national origin, are hereby deleted.
<br />Note 1: This policy does not insure against loss or damage arising as the result of unpaid charges for public utilities
<br />furnished by any county, municipality, or public service corporation, which may be or may become a lien upon the land
<br />insured hereby under any provision of the Florida Statutes including Section 159.17; and/or any county, municipal, or
<br />special taxing district assessment, including those levied under the provisions of Chapter 190, Florida Statutes.
