However, neither Public Works nor the Drainage <br />District will assume the obligation of maintaining the <br />road.. Therefore, both Public Works and the Drainage <br />District would like to monitor the road impact caused by <br />the proposed use, and have the ability to request that the <br />Board of County Commissioners restrict or disallow. <br />continuation of the use if the road is adversely impacted. <br />Although the use will be limited, such a condition would <br />safeguard against unwanted maintenance obligations. <br />An unpaved drive is to be cleared from the 17th Street S.W. <br />extension point of access to the pit area. The <br />Environmental Planner has indicated that a tree removal <br />permit can be issued upon approval of the site plan and <br />special exception use request. <br />7) Drainage: No Stormwater Management Permit is required, and <br />no drainage improvements are necessary. <br />8) Landscape Plan: All requirements of Ordinance #8447 have <br />been met. Trees completely surround the proposed area of <br />development. <br />9) Utilities: The Environmental Health Director has approved <br />the installation of a well to wash -off vehicles exiting the <br />pit. He has also approved the use of portable toilets <br />during the mud -bogging contests. <br />10) Surrounding Land Uses: North: vacant <br />South: vacant, groves <br />East: I-95, County landfill <br />West: groves <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners approve <br />the special exception use request subject to the following <br />condition: <br />1) That the Board of County Commissioners reserve the right to <br />restrict or disallow the use at any time, if it is <br />determined that the use adversely impacts the road to the <br />subject site, known as the 17th Street S.W. extension. <br />Staff Planner Stan Boling presented staff's recommendation <br />for approval of the special exception use request subject to <br />the condition that the Board reserve the right to restrict or <br />disallow the use at any time, if it is determined that the use <br />adversely impacts the road to the subject site. He explained <br />that the Oslo'Mud Boggers are a group of people who identify <br />themselves with that name and they are not a legal entity.
