The last correspondence with the owner was generated by the <br />Utility Services Division on April 11, 1984. In that correspon- <br />dence, the division requested modifications to the proposed <br />wastewater treatment plant and the water distribution system. <br />Mr. Clark responded that he would address the modifications when <br />a County water line was extended to his property. The water main <br />was completed and has been operational since .April, 1985. Mr. <br />Clark,has verbally indicated on several occasions that he will <br />be proceeding towards obtaining a franchise and construction <br />permits for the water and wastewater system; however, officially, <br />it appears that he has submitted nothing since approximately <br />March, 1984. <br />ANALYSIS: <br />The rationale behind authorizing the County Commission to termi- <br />nate site plan approval relates to the public's interest. The <br />process allows the County to ensure that projects which are not <br />constructed within a reasonable time .after site plan approval <br />will conform to applicable regulations which have been enacted <br />since that approval was granted. By adopting new land develop- <br />ment related ordinances, the County Commission, has determined <br />that the adherence to the requirements set forth`I*in said- ordi- <br />nances is in the public's best interest. -gince approval of the <br />Oaks Paradise Mobile Home Park site plan, the following applica- <br />ble ordinances have been adopted: <br />1. The Comprehensive Plan <br />2. Stormwater Management and Flood Protection <br />3. Off-street Parking Pavement Types <br />4. Off-street Parking & Loading Regulations <br />S. Tree Protection <br />6. Landscaping <br />7. Residential Zoning Districts <br />CONCLUSION: <br />In reviewing the record of construction of Oaks Paradise, staff <br />still maintains that Mr. Clark has not demonstrated a good faith <br />effort to complete the project in that only 7 slabs have been <br />poured and a small portion of the internal drive paved in 5 <br />years. In addition, it is staff's position that Mr. Clark has <br />not diligently pursued the acquisition of County water service or <br />the approval of a wastewater franchise. Therefore, it would be <br />in the public's best interest to terminate approval of the Oaks <br />Paradise Mobile Home Park site plan application. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners direct <br />the staff to initiate the site plan termination process for the <br />Oaks Paradise Mobile Home Park site plan. <br />27 <br />BOOK 62 Far_,F 735 <br />
