He <br />clarified that this is not a hearing for site plan termination, <br />it is an update on the progress of construction on the site with ' <br />a recommendation that a hearing,be scheduled to terminate the <br />site plan. He wished to have it made clear that the Clarks were <br />notified by phone two weeks ago and a copy of today's agenda was <br />sent out later; the implication that only a 1 -day notice was <br />given is misleading. <br />Commissioner Wodtke noticed that the applicant was shaking <br />his head indicating that there was no phone call, and felt that <br />we should send a written notice when something like this comes up <br />so that we have documentation that notice was given. <br />Commissioner Scurlock felt that the Board should consider <br />the progress made over the entire five years since the site plan <br />was approved, but Attorney Glenn believed the Board should <br />consider the progress made in just the last six months. <br />Attorney Glenn stressed that last May the Board told the <br />Clarks to go out and start working and that is what the Clarks <br />have done. They have spent over $100,000 on this project and for <br />the Board to come back now and terminate their plan would be an <br />unnecessary hardship. <br />Mr. Clark stated that they have diligently pursued the <br />completion of the project as they want to open Phase I as soon as <br />possible. They have laid 700 feet of roadway over the five <br />years; the electrical company is going to install the primary <br />lines underground; they have built pedestals for the electric <br />backboards. After Phase I, they will begin on Phase II. They <br />have a permit from the DER on the proposed sewer treatment plant. <br />They had a contract to purchase a plant, but it has since <br />expired. They know that they have to sit down with the County <br />and modify this. Mr. Clark stressed how hard they have worked <br />towards this. <br />30 <br />
