BK: 2901 PG: 1161 <br />A TRUE COPY <br />CERTIFICATION ON LAST PAGE <br />J.R. SMITH, CLERIC <br />shall add all other areas of the NETWORK to its membership in said organization. In <br />accordance with procedures established by Sunshine 811, the City and County shall <br />receive requests for locates and perform, or cause the performance of, the associated <br />work necessary to determine the location of such underground portions of the <br />NETWORK. The members shall cooperate to develop and maintain a current map <br />depicting which member will be responsible for locates in the various sections of the <br />NETWORK. <br />If damage occurs to the NETWORK, the net costs to repair the damage shall be shared <br />by the affected members in accordance with the cost sharing provisions of this <br />Agreement after deduction for all payments, reimbursements, allowances, and credits <br />given or made by any third -party causing or responsible for the damage. Members shall <br />not be entitled to payment from each other for damages to the NETWORK due to <br />inaccurate or inadequate locates. Any costs to repair damage to the NETWORK <br />caused by work performed by or for a member notwithstanding an accurate locate shall <br />be the sole responsibility of that member. <br />SECTION 18. Grants. <br />Should a member receive grant funds to assist with the construction or maintenance of <br />the NETWORK, any provisions, limitations or restrictions associated with the grant(s) <br />shall not affect or apply to the other members not a party to the grant. In addition, no <br />grant provisions, limitations, or restrictions shall in any way affect the ownership <br />interests of the other members in the NETWORK or restrict or affect the intended use of <br />the NETWORK by the other members or Licensees. <br />Should a member submit an application for grant funding associated with the <br />NETWORK and such application requires the concurrence of the other members, such <br />concurrence shall not be unreasonably withheld so long as such concurrence does not <br />limit, restrict, or in any way affect ownership or use of the NETWORK by the member <br />providing its concurrence and such concurrence does not subject or extend any <br />requirements, provisions, or liability associated with the grant application to the member <br />providing its concurrence. Whenever application is proposed by a member for a grant <br />which will or can benefit one or more other members, such other members shall have <br />the option to become a co -applicant and participant for the grant unless doing so would <br />detrimentally affect the likelihood of approval. <br />Members not participating in a grant shall not be liable in any manner whatsoever for <br />repayment of grant funds which have been received by a member. The member <br />receiving such a grant(s) associated with the NETWORK shall be solely responsible for <br />satisfying any and all reporting requirements associated with the receipt of such grant <br />funds, submittal of any and all documentation necessary for reimbursement of expenses <br />under any associated grant agreement, and repayment of any grant funds received by <br />such member that are required by the granting agency to be repaid for whatever <br />reason, unless otherwise agreed by the other members. <br />Page 11 of 19 <br />2015.2.06.Edited.Fiber Optic Agreement.CLEAN.doc <br />
