<br /> The Indian River Club, Ltd., a Florida limited partnership (MORTGAGOR),
<br /> by Indenture of Mortgage bearing the 17th day of September, 1998, and recorded in
<br /> O.R. Book 1121, Page 1785, of the Public Records of Indian River County, Florida,
<br /> together with those certain Assignments of Rents and Losses In O.R. Book 1121, at
<br /> Page 1883; and in O.R. Book 1121, at Page 1877; and together with that certain
<br /> Collateral Assignment of Agreements Affecting Real Estate in O.R.Book 1121, at Paye
<br /> 1934, mortgaged unto First National Bank and Trust Company of the Treasure
<br /> Coast (MORTGAGEE), the premises described, to secure the payment of the sums
<br /> with interest as therein mentioned;
<br /> AND WHEREAS,the said MORTGAGOR has requested the said MORTGAGEE
<br /> to release the premises hereinafter described, being part of said mortgaged premises,
<br /> from the lien and operation of said Mortgage;
<br /> NOW, THEREFORE, KNOW YE, that the said MORTGAGEE, in considerelion
<br /> of the premises and of the sum of ONE DOLLAR to it paid by the said MORTGAGOR
<br /> at the time of the execution hereof, the receipt whereof is hereby acknowledged, does
<br /> remiss, release,quitclaim,exonerate,and discharge from the lien and operation of said
<br /> mortgage unto the said MORTGAGOR and its heirs and assigns, all that piece, parcel,
<br /> or tract of land,being a part of the premises conveyed by said mortgage,to-Wit:
<br /> SEE EXHIBIT"A"ATTACHED HERETO AND MADE A PART HEREOF.
<br /> TO HAVE AND TO BOLD the some with the appurtenances, unto the said
<br /> MORTGAGOR its heirs and assigns forever, free, exonerated, and discharged of and
<br /> from the lien of said mortgage, and every part thereof; provided always, nevertheless,
<br /> that nothing herein contained shall in anywise impair, alter,or diminish the effect, lien,
<br /> or encumbrance of the aforesaid Mortgage on the remaining part of said mortgaged
<br /> premises not hereby released therefrom, or any of the rights and remedies of the
<br /> holder thereof.
