INDIAN RIVER COUNTY ORDINANCE NO. 85- 102 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, AMENDING ORDINANCE NO. 84-18, <br />SECTION 8-H "IMPACT FEE, EXPANSION POLICY," <br />AS AMENDED, SO THAT UNDER CERTAIN CONDITIONS <br />NOT ONLY WATER AND SEWER IMPACT FEES BUT <br />ALL OTHER CHARGES AND FEES RELATED THERETO, <br />EXCEPT FOR DEPOSITS, MAY BE PAID OVER A <br />PERIOD OF FIVE YEARS, PLUS INTEREST; PRO- <br />VIDING AN EFFECTIVE DATE. <br />WHEREAS, Indian River County presently has a <br />provision for paying water or sewer impact fees over a period of <br />five years at an interest rate as determined by the Board; and <br />WHEREAS, there are various fees and charges in <br />addition to impact fees which must be paid at the time of <br />connection and which amount to a substantial amount, such that it <br />would be fair to spread their payment over five years as is done <br />with water and sewer impact fees; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA. that: <br />SECTION 1. TIME PAYMENT OF FEES AND CHARGES <br />OTHER THAN IMPACT FEES <br />The second paragraph of Section 8-H of Ordinance 84-18, <br />as amended. which presently reads as follows: <br />"Upon- a showing of proper hardship to the <br />Commission, the Commission may allow in its sole <br />discretion payment of the water and/or sewer <br />Impact fees in whole or in part over a period of <br />five (5) years at such interest rate to be <br />determined by the Board." <br />shall be amended to read as follows: <br />The Division of Utility Services may allow <br />payment of the water and sewer impact fees and <br />any and all other charges or fees, except <br />deposit fees, in whole or in part over a period <br />of five (5) years at an interest rate of 12%. <br />Before allowing such a time payment plan, the <br />Utility Services Director shall determine that <br />the cash flow and other financial positions of <br />the Utility will not be harmed thereby. <br />SECTION 2. EFFECTIVE DATE <br />This Ordinance shall be effective as provided by Law. <br />APPROVED AND ADOPTED by the Board of County <br />Commissioners of Indian River County, Florida, on this 18thday of <br />December <br />. 1985. <br />Approved as to form <br />and legal sufficiency: <br />Charles P.
