<br />This warranty Peed Made the � day of December
<br />George Lier and Jeannette M. Lier, his wife,
<br />hereinafter called the grantor, to
<br />A. D. 1985 by
<br />Indian River County, a political subdivision of the State
<br />of Florida
<br />whose posto f f ice address is
<br />hereinafter called the grantee:
<br />Vero Beach, FL 32960
<br />(Wherever used herein the terms .. tor" and "grantee" include all the parties to this instrument and
<br />the heirs, legal representatives and luri of individuals, and the successors and assigns of corporations)
<br />Witnesseth: That the grantor, for and in consideration of the sum of $ 10.0 0 and other
<br />valuable considerations, receipt whereof is hereby acknowledged, hereby grants, bargains, sells, aliens, re-
<br />mises, releases, conveys and confirms unto the grantee, all that certain land situate in Indian River
<br />County, Florida, viz:
<br />All of the North 100 feet (measured on a north -south line)
<br />lying East of the East right of way -of State Road AlA, of
<br />Government Lot 11, Section 10, Township 31 South, Range 39
<br />East. Said land lying and being in Indian River County,
<br />Florida.
<br />The Grantors are making a gift of the above described property
<br />to Indi:.an River Courity upon the following express covenants,
<br />conditions- and limitationswhich shall run with the land and be
<br />binding on the Grantee and the successors and assigns of the
<br />Grantee, which covenants, conditions and limitations are as
<br />follows:
<br />1. The property shall be usely solely for public beach
<br />recreational purposes without charge to the public.
<br />2. The property shall not be conveyed to any third party
<br />including, without limitation, the State of'Florida or
<br />agencies of the State of Florida, or the Federal Government
<br />or agencies of the Federal Government, and shall not be placed
<br />under the control of the State of Florida, its agencies, or
<br />the Federal Government or its agencies.
<br />3. Excepted from the above restrictions shall be the
<br />widening of State Road AlA and in the event additional
<br />right of way is required for State Road AIA, then such part
<br />of the property as is reasonable and necessary may be used
<br />for State Road AlA right of way purposes.
<br />In the event that any of the foregoing covenants, conditions
<br />and limitations are breached, -theft -the Grantor, or their
<br />heirs, successors, administrators or assigns may file an
<br />action for specific performance, declaratory judgment, or
<br />other relief permitted under the laws of the State of
<br />Florida, and/or the Grantors, their heirs, successors,
<br />administrators or assigns, may file an action for reverter
<br />of the title to the property to the Grantors, their heirs,
<br />successors, administrators or assigns.
